Article 1 – Definitions

Additional Agreement
An agreement whereby the consumer acquires products or services in connection with a distance contract, supplied by RESTED or a third party acting on behalf of RESTED.

Withdrawal Period
The period during which the consumer may exercise the right of withdrawal.

Consumer
A natural person acting for purposes outside their business, trade, or profession.

Day
A calendar day.

Long-term Contract
A contract relating to the regular delivery of goods or services over a defined period.

Durable Medium
Any medium that allows information to be stored and accessed later, such as email.

Right of Withdrawal
The consumer’s statutory right to withdraw from a distance contract within the withdrawal period.

Distance Contract
A contract concluded without the simultaneous physical presence of RESTED and the consumer, using distance communication.

Article 3 – Applicability

These general terms and conditions apply to all offers made by RESTED and to all distance contracts concluded between RESTED and the consumer.

Before the contract is concluded, these terms will be made available to the consumer in a manner that allows storage on a durable medium.

If additional terms apply to specific products or services, the consumer may rely on the provision that is most favourable in the event of any inconsistency.


Article 4 – The Offer

If an offer has a limited duration or is subject to specific conditions, this will be clearly stated.

Product descriptions and images are intended to provide an accurate representation. Minor deviations may occur. Obvious errors or mistakes do not bind RESTED.

Each offer clearly states the rights and obligations associated with acceptance.


Article 5 – The Agreement

The agreement is concluded once the consumer accepts the offer and fulfils the stated conditions.

RESTED will confirm receipt of the order electronically without undue delay. Until confirmation is provided, the consumer may cancel the order.

RESTED implements appropriate technical and organisational measures to protect personal data and ensure a secure purchasing environment.

RESTED reserves the right, within legal limits, to assess whether payment obligations can be met and may refuse or condition orders where justified.


Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the contract within 60 days from the day the product is received, without providing any reason.

RESTED may request feedback regarding the withdrawal but shall not require justification.


Article 7 – Consumer Obligations During the Withdrawal Period

During the withdrawal period, the consumer must handle the product and packaging with care.

The product may only be inspected to the extent necessary to determine its nature, characteristics, and functioning.

If the consumer exercises the right of withdrawal, the product must be returned with all supplied accessories and, where reasonably possible, in its original packaging.


Article 8 – Exercising the Right of Withdrawal & Costs

To exercise the right of withdrawal, the consumer must notify RESTED within the withdrawal period by email or written communication.

The consumer bears the direct cost of returning the product.


Article 9 – Obligations of RESTED Upon Withdrawal

RESTED will confirm receipt of the withdrawal notification without delay.

Refunds will be issued after the returned product has been received and inspected.

Refunds will be made using the original payment method, unless otherwise agreed.


Article 10 – Exclusions to the Right of Withdrawal

The right of withdrawal may be excluded for products that are:

  • Made to the consumer’s specifications or clearly personalised

  • Of a personal or hygienic nature if unsealed after delivery

  • Unsuitable for return due to their nature

  • Liable to deteriorate or expire rapidly

  • Subject to price fluctuations beyond RESTED’s control

  • Audio, video, or software products with a broken seal


Article 11 – Prices

All prices are stated in pounds sterling (£) and include VAT where applicable.

Prices will not increase during the stated offer period, except for changes in VAT rates.

RESTED may offer variable pricing for products subject to market fluctuations, where clearly stated.


Article 12 – Conformity & Warranty

RESTED guarantees that products comply with the agreement, the product description, and applicable UK consumer legislation.

This warranty does not affect the consumer’s statutory rights under UK law.


Article 13 – Delivery & Performance

RESTED will take due care in processing and delivering orders.

Delivery will take place at the address provided by the consumer.

Orders will be dispatched as soon as reasonably possible and no later than 30 days, unless otherwise agreed.

If delivery is delayed, the consumer will be informed and may cancel the contract at no cost.

The risk of damage or loss transfers to the consumer upon delivery.


Article 14 – Ongoing Contracts: Duration, Termination & Renewal

Indefinite contracts may be terminated by either party with one month’s notice.

Fixed-term contracts end automatically at the agreed end date unless otherwise stated.

Automatic renewal beyond the agreed term is not permitted unless explicitly agreed.


Article 15 – Payment

Unless otherwise agreed, payment must be completed at the time of purchase.

RESTED will not require advance payments exceeding statutory limits where applicable.

Late payments may result in statutory interest and reasonable recovery costs.


Article 16 – Complaints Procedure

Complaints must be submitted in writing and clearly described.

RESTED aims to respond within 14 days of receipt.

If additional time is required, the consumer will be informed of the expected resolution timeframe.


Article 17 – Governing Law & Disputes

All agreements between RESTED and the consumer are governed by the laws of England and Wales.

Disputes shall be submitted to the competent courts of England and Wales, unless mandatory consumer law provides otherwise.


Article 18 – Additional Provisions

Any additional or deviating provisions must not disadvantage the consumer and must be provided in writing or on a durable medium.
